JamunJar (“We/us/our/JamunJar”) operates and manages an online marketplace platform, including the website www.jamunjar.com and the JamunJar mobile application (Android and iOS) (collectively, the “Platform”). JamunJar is engaged in the business of connecting sellers and buyers for the buying and selling of goods and services, both tangible and digital, and providing e-commerce services, including product listings, advertising, payment processing, customer support and other services and facilities made available by or through JamunJar (collectively, the “Services”). The Services may be accessed or availed through the Platform or through such other electronic, digital, telephonic, physical or other mode or medium as may be made available by JamunJar. JamunJar acts solely as a intermediary and marketplace facilitator. JamunJar does not itself provide the underlying products and services, medical advice, diagnosis, treatment, pharmacy services, diagnostic services, nursing services, physiotherapy services or other professional services made available through the Platform, unless expressly stated otherwise.JamunJar acts purely as an intermediary within the meaning of Section 2(1)(w) of the Information Technology Act, 2000, and is entitled to the exemption from liability available to intermediaries under Section 79 of that Act, subject to JamunJar's compliance with the due diligence requirements prescribed under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, as further detailed in JamunJar's Grievance Redressal Policy. and undertakes no role in the selection, initiation, modification or endorsement of any healthcare service, consultation, diagnosis, prescription, treatment or advice made available through the Platform. JamunJar does not employ, engage, direct, supervise, train or control any doctor, registered medical practitioner, diagnostic centre, pharmacy, nurse, physiotherapist or other healthcare provider listed on the Platform, and exercises no clinical oversight whatsoever over the services rendered by such providers.

This Website and the Platform are not intended for, and must not be relied upon in, a medical emergency. In the event of a medical emergency, you must immediately contact your local emergency medical services (112 in India) or visit the nearest hospital. JamunJar shall have no liability whatsoever for any reliance placed on the Website or Platform in an emergency situation.

By accessing, using or registering on the Platform, or by otherwise accessing or availing of the Services through any electronic, digital, telephonic, physical or other mode or medium made available by JamunJar, you confirm that you have read, understood and agree to be legally bound by the terms of this legal disclaimer, the Privacy Policy and the Terms and Conditions governing the Platform (collectively, “the Governing Conditions”). JamunJar reserves the right to make changes to the Platform and the Governing Conditions at any time. Your usage of the Platform or Services and information is at your own risk, save to the extent any loss arises from JamunJar's gross negligence or wilful default. The Website merely facilitates interactions between Users and independent third-party service providers and nothing contained herein shall be construed as creating any obligation on JamunJar to provide or render healthcare services or medical treatment.If you do not agree with any of the Governing Conditions, you may discontinue usage of the Platform and/or Services and information. The services and information provided on or through the Platform are for general guidance and information purposes only and they do not in any manner indicate any assurance, advice or opinion of any manner whatsoever. Nothing contained on the Platform shall constitute medical advice, diagnosis, prescription or treatment and Users should exercise their own judgment and seek advice from an appropriate independent healthcare professional wherever necessary. JamunJar makes no representations, warranties or guarantees (express or implied) that the contents of the Platform or services and information are free from viruses or other code or computer programming or anything else which has contaminating or destructive properties and shall have no liability in respect thereof. Any of the Services and/or information may be prone to shortcomings, defects or inaccuracies due to technical reasons.

JamunJar reserves the right to monitor this Website and all its content, and to disclose any information as necessary to satisfy any law, regulation or governmental request, or to edit or remove any information or materials, in whole or in part, that in JamunJar's sole discretion are objectionable or in violation of these Terms.

While JamunJar undertakes basic verification of registration credentials of medical practitioners and healthcare providers listed on the Platform as a condition of onboarding, such verification is conducted solely for the purpose of Platform access and does not constitute a warranty, representation or guarantee by JamunJar as to the continued validity, accuracy or good standing of such credentials, or as to the competence, conduct or professional standards maintained by such provider at any given time.

All Services and/or information are sourced from experts independent or third party service providers/intermediary, which may also include reference to any associate or group company. However, any such Services and information shall not be construed as belonging to, representing the views of, or being endorsed by JamunJar. JamunJar does not employ, supervise, control or endorse such third-party service providers and all healthcare services, consultations, diagnoses, prescriptions, treatments, diagnostic services, pharmacy services, nursing services and other professional services are independently rendered by the relevant third-party provider, who shall remain solely responsible for such services and for compliance with applicable laws and professional standards. Any service and information provided or sourced from group/associate company are incidental. JamunJar is an independent entity and such services and information from any group or associate company are not in any manner intended or to be construed as being endorsed by JamunJar.

The Services and/or information are dependent on various assumptions, individual preferences and other factors and thus, results or analyses cannot be construed to be entirely accurate and may not be suitable for all categories of users. Hence, they should not be solely relied on when making any decisions. Your decision shall always be at your own discretion and based on your independent research and nothing contained on the Website or in any Services and/or information would construe JamunJar or any of its employees/authorized representative as having been in any way involved in your decision-making process. Where any consultation, healthcare service or product is obtained through the Website, all clinical, professional and commercial decisions, professional advice, prescriptions, treatment plans and healthcare outcomes shall remain the sole responsibility of the relevant independent third-party healthcare provider.

JamunJar's role is limited to facilitating discovery of, and payment for, services offered by independent third-party providers. Any dispute relating to processing of payments, refunds or transaction failures on the Platform shall be addressed by JamunJar in accordance with its refund policy and, for issues concerning the functioning of the Platform itself, in accordance with JamunJar's Grievance Redressal Policy; however, any dispute, claim or grievance relating to the quality, accuracy, adequacy, safety or outcome of any medical consultation, diagnosis, prescription, treatment or other healthcare service shall be a matter solely between the User and the concerned third-party provider, and JamunJar shall bear no responsibility or liability whatsoever in respect thereof.

JamunJar/its employees/authorized representatives will not be responsible for any liability in respect of any person/entity directly or indirectly suffering any consequential losses, damages or claims of whatever nature as a result of any shortcoming, defect or inaccuracy that may have crept in on this Website, or otherwise using the information available on this Website in any manner. Part of this Website may contain material submitted by third parties and JamunJar does not accept liability in respect of any such material. JamunJar is not responsible for any errors, omissions or representations on any of the pages or on any links on any of the pages. JamunJar does not independently verify, monitor or guarantee the accuracy, completeness, legality or reliability of information, products or services provided by third-party service providers, except to the extent required under applicable law.

Any ranking, ordering, rating, review, recommendation or search result displayed on the Platform in relation to a healthcare provider is generated for user convenience only and does not constitute, and shall not be construed as, an endorsement, verification, recommendation or guarantee by JamunJar of the qualifications, competence, conduct or quality of service of such provider. Users are solely responsible for independently verifying the credentials, registration and suitability of any healthcare provider prior to availing their services.

The usage of the Platform is exclusively subject to the laws of India and the jurisdiction of the courts of Mumbai in India. JamunJar expressly disclaims any implied warranties or liabilities imputed by the laws of any other jurisdiction. This Platform is specifically for users in the territory of India. While general informational access to the Website is not restricted to users outside India, the purchase of medicines, diagnostic tests and other regulated healthcare services through the Platform is intended solely for users located in India, and JamunJar makes no representation that such services are appropriate, available or lawful for use outside India.

I hereby declare that I agree to receive communications from “JamunJar” on WhatsApp. I understand that these communications may include information related to healthcare and other products and services made available through the Platform by independent third-party service providers, as well as information relating to the Platform and its services, and marketing and promotional materials from JamunJar.I acknowledge that my personal information, including my WhatsApp number, will be used by “JamunJar” for the purpose of sending me these communications in accordance with the Privacy Policy and applicable law. I also understand that I have the right to opt-out of receiving these communications at any time by contacting “JamunJar” at support@jamunjar.com.By signing below, I confirm that I have read and understood the terms of this declaration, and I consent to receiving communications from “JamunJar” on WhatsApp.

Declaration Form for Processing of Health-Related Information

I understand that certain information shared by me on the Platform, including health-related information, may constitute “sensitive personal data” under applicable Indian data protection law. I expressly consent to such information being collected, processed, stored and shared by JamunJar with the relevant third-party healthcare provider(s) solely for the purpose of availing the service requested by me, in accordance with JamunJar's Privacy Policy. I understand that I may withdraw this consent at any time in the manner set out in JamunJar's Privacy Policy, and that such withdrawal shall not affect the lawfulness of processing carried out prior to withdrawal.

Declaration Form for Override of DND

I hereby declare that I authorise “JamunJar” to override my DND (Do Not Disturb) registration to contact me for the following categories of communication (please indicate separately):(a) Transactional communications relating to orders, deliveries, appointments, prescriptions, test results and account activity; and/or(b) Marketing and promotional communications relating to JamunJar's products, services and offers.I acknowledge that my personal information, including my phone number and email address, will be used by “JamunJar” for the purpose of sending me these communications in accordance with the Privacy Policy and applicable law. I also understand that I have the right to opt-out of receiving these communications at any time by contacting “JamunJar” at support@jamunjar.com, and that this consent is valid until explicitly withdrawn.I hereby confirm that I have carefully read and understood the terms of this declaration, and that I give my express consent for “JamunJar” to contact me for the categories of communication indicated above, even if I have registered for DND with my telecom service provider.
